Gia hạn giấy phép lao động 2026: Ngày nộp hồ sơ quyết định quy định được áp dụng

Ngày 20/10/2026, Chính phủ ban hành Nghị định số 393/2026/NĐ-CP quy định về người lao động nước ngoài làm việc tại Việt Nam. Nghị định có hiệu lực từ ngày 05/12/2026 và thay thế Nghị định 219/2025/NĐ-CP.

Theo khoản 2 Điều 35 Nghị định 393, trường hợp người sử dụng lao động đã nộp hồ sơ đề nghị cấp, cấp lại, gia hạn hoặc thu hồi giấy phép lao động trước ngày nghị định có hiệu lực thì hồ sơ tiếp tục được giải quyết theo Nghị định 219/2025/NĐ-CP.

Đồng thời, khoản 5 Điều 35 quy định riêng đối với các hồ sơ gia hạn GPLĐ đã nộp theo Nghị quyết 24/2026/NQ-CP trước ngày 05/12/2026. Những hồ sơ này tiếp tục được xem xét, giải quyết theo Nghị quyết 24.

Như vậy, về nguyên tắc:

• Nộp trước ngày 05/12/2026: Hồ sơ thuộc phạm vi quy định chuyển tiếp tại Điều 35, áp dụng các quy định tương ứng của Nghị định 219 và Nghị quyết 24.
• Nộp từ ngày 05/12/2026: Hồ sơ mới thực hiện theo Nghị định 393/2026/NĐ-CP.

Điểm cần lưu ý là ngày 05/12/2026 rơi vào thứ Bảy. Doanh nghiệp cần xác nhận thời điểm tiếp nhận hồ sơ thực tế trên hệ thống dịch vụ công hoặc với cơ quan có thẩm quyền khi nộp sát thời điểm chuyển tiếp.

Gia hạn giấy phép lao động 2026: Ba thay đổi quan trọng từ ngày 05/12

1. Không còn giấy khám sức khỏe trong hồ sơ gia hạn

Đây là một trong những thay đổi đáng chú ý của thủ tục gia hạn giấy phép lao động 2026.

Theo Nghị định 219 và quy định đơn giản hóa tại Nghị quyết 24/2026/NQ-CP, hồ sơ gia hạn có yêu cầu giấy khám sức khỏe. Tuy nhiên, trong trường hợp kết quả khám sức khỏe đã được kết nối, chia sẻ trên hệ thống thông tin quản lý khám chữa bệnh hoặc cơ sở dữ liệu quốc gia về y tế theo quy định, người nộp hồ sơ không phải nộp riêng thành phần giấy tờ này.

Từ ngày 05/12/2026, Điều 28 Nghị định 393 không còn quy định giấy khám sức khỏe là thành phần bắt buộc trong hồ sơ gia hạn GPLĐ.

Đây là thay đổi giúp giảm yêu cầu về giấy tờ cho doanh nghiệp và người lao động nước ngoài.

Tuy nhiên, cần phân biệt việc không yêu cầu giấy khám sức khỏe trong hồ sơ gia hạn GPLĐ với các nghĩa vụ khám sức khỏe khác theo quy định pháp luật có liên quan.

2. Đơn giản hóa thủ tục thông báo tuyển dụng lao động Việt Nam

Một thay đổi đáng chú ý khác là yêu cầu liên quan đến việc thông báo tuyển dụng người lao động Việt Nam.

Theo Mẫu số 03 ban hành kèm Nghị định 219, nội dung báo cáo giải trình về việc tuyển dụng lao động Việt Nam được áp dụng đối với các trường hợp cấp hoặc gia hạn GPLĐ theo những hình thức làm việc tương ứng.

Tuy nhiên, Mục II Mẫu số 03 Phụ lục I Nghị định 393 quy định nội dung thông báo tuyển dụng chỉ áp dụng đối với trường hợp cấp GPLĐ.

Do đó, khi thực hiện thủ tục gia hạn theo Nghị định 393, doanh nghiệp không phải thực hiện phần thông báo tuyển dụng lao động Việt Nam tại Mục II Mẫu số 03.

Sự thay đổi này đặc biệt đáng chú ý đối với doanh nghiệp sử dụng nhiều lao động nước ngoài theo hình thức hợp đồng lao động.

3. Rút ngắn thời gian giải quyết gia hạn từ 10 xuống 05 ngày làm việc

Theo quy định trước đây, thời hạn giải quyết hồ sơ gia hạn GPLĐ là 10 ngày làm việc kể từ khi nhận đủ hồ sơ.

Từ ngày 05/12/2026, khoản 3 Điều 29 Nghị định 393 quy định thời gian giải quyết là 05 ngày làm việc kể từ ngày nhận đủ hồ sơ.

Việc rút ngắn thời gian giải quyết tạo điều kiện để doanh nghiệp chủ động hơn trong kế hoạch sử dụng lao động nước ngoài.

Tuy nhiên, đây là thời hạn xử lý theo quy định đối với hồ sơ đầy đủ, hợp lệ, không phải cam kết mọi hồ sơ đều được giải quyết trong 05 ngày nếu phải bổ sung hoặc chỉnh sửa giấy tờ.

Hồ sơ gia hạn giấy phép lao động 2026 gồm những giấy tờ gì?

Theo Điều 28 Nghị định 393/2026/NĐ-CP, hồ sơ đề nghị gia hạn GPLĐ gồm các thành phần sau:

1. Văn bản đề nghị gia hạn GPLĐ

Văn bản báo cáo giải trình nhu cầu sử dụng lao động nước ngoài và đề nghị gia hạn GPLĐ theo Mẫu số 03 Phụ lục I ban hành kèm Nghị định 393.

2. Bản sao trang nhân thân hộ chiếu

Hộ chiếu phải còn thời hạn theo quy định.

Không phải nộp riêng thành phần này nếu cơ quan có thẩm quyền khai thác được thông tin từ cơ sở dữ liệu quốc gia về xuất nhập cảnh.

3. Ảnh chân dung

Hai ảnh màu hoặc file ảnh kích thước 4×6 cm theo yêu cầu.

Trường hợp khai thác được thông tin từ cơ sở dữ liệu người lao động nước ngoài làm việc tại Việt Nam thì áp dụng quy định về miễn nộp thành phần này.

4. Giấy tờ chứng minh hình thức làm việc

Chuẩn bị theo quy định đối với các trường hợp phải nộp, căn cứ hình thức làm việc thực tế của người lao động nước ngoài.

5. Bản sao GPLĐ còn thời hạn đã được cấp

Có thể không phải nộp riêng nếu thông tin tương ứng được khai thác từ cơ sở dữ liệu người lao động nước ngoài làm việc tại Việt Nam.

Đáng chú ý, Nghị quyết 24/2026/NQ-CP đã đơn giản hóa một số yêu cầu về hồ sơ trong giai đoạn trước khi Nghị định 393 có hiệu lực.

Ví dụ 1: GPLĐ hết hạn ngày 10/12/2026

Theo Nghị định 219, hồ sơ gia hạn phải được nộp trước ít nhất 10 ngày so với ngày hết hạn.

Do đó, doanh nghiệp không thể mặc nhiên chờ đến ngày 04/12/2026 mới nộp, vì thời điểm này không còn đáp ứng khoảng thời gian tối thiểu theo quy định.

Ví dụ 2: GPLĐ hết hạn ngày 10/01/2027

Theo khoảng nộp của Nghị định 219, doanh nghiệp chưa đến thời điểm được nộp hồ sơ gia hạn.

Do đó, doanh nghiệp cần lập kế hoạch nộp theo khoảng thời gian được quy định tại Nghị định 393, với điều kiện hồ sơ đáp ứng các yêu cầu áp dụng.

Khuyến nghị: Đối với mỗi GPLĐ, HR nên xác định ngày nộp sớm nhất và ngày nộp muộn nhất trước khi quyết định áp dụng phương án nào.

Những lưu ý quan trọng khi gia hạn GPLĐ theo Nghị định 393

1. Không được nộp sát ngày hết hạn

Khoản 1 Điều 29 Nghị định 393 yêu cầu hồ sơ gia hạn phải được nộp trước ít nhất 10 ngày làm việc so với ngày GPLĐ hết hạn.

Do đó, doanh nghiệp cần tính theo ngày làm việc, không sử dụng cách tính đơn giản là 10 ngày theo lịch.

Tổng quan 12 thay đổi trọng yếu theo Nghị định 393/2026/NĐ-CP

Nghị định 393/2026/NĐ-CP tập trung vào bốn nhóm thay đổi chính:

Nới lỏng: Mở rộng điều kiện chuyên môn đối với chuyên gia, giám đốc điều hành và đơn giản hóa thủ tục gia hạn giấy phép lao động.

Siết chặt: Điều chỉnh các trường hợp miễn giấy phép lao động có nguy cơ bị lạm dụng, đặc biệt là di chuyển nội bộ doanh nghiệp và làm việc ngắn hạn.

Số hóa: Đẩy mạnh khai thác dữ liệu từ các cơ sở dữ liệu nhà nước để thay thế một số giấy tờ trong hồ sơ.

Điều chỉnh: Thay đổi cách tính một số mốc thời gian thực hiện thủ tục và quy định trực tiếp trách nhiệm của người sử dụng lao động.

Dưới đây là 12 thay đổi quan trọng mà doanh nghiệp cần nắm rõ.

A. Nhóm quy định được nới lỏng

1. Mở rộng các trường hợp không thuộc diện cấp giấy phép lao động từ 15 lên 18 trường hợp

Nghị định 393/2026/NĐ-CP mở rộng số trường hợp không thuộc diện cấp giấy phép lao động từ 15 lên 18 trường hợp.

Các nội dung bổ sung bao gồm:

• Người được cấp thẻ miễn thị thực đặc biệt.
• Chuyên gia làm việc trong lĩnh vực công nghệ chiến lược và thân nhân.
• Nhân lực trong lĩnh vực trí tuệ nhân tạo.

Đối với nhóm giáo dục, Nghị định mới không còn yêu cầu xác nhận của Bộ Giáo dục và Đào tạo (BGDĐT).

2. Mở rộng tiêu chuẩn chuyên gia từ 02 lên 06 trường hợp

Nghị định 393 mở rộng tiêu chuẩn xác định chuyên gia nước ngoài từ 02 lên 06 trường hợp.

Các trường hợp được bổ sung gồm:

• Người tốt nghiệp đại học thuộc ngành công nghệ chiến lược, không yêu cầu kinh nghiệm làm việc.
• Người tốt nghiệp loại giỏi tại trường đại học thuộc top 500 thế giới và có ít nhất 01 năm kinh nghiệm.
• Chuyên gia trong lĩnh vực văn hóa, nghệ thuật và thể thao.
• Chuyên gia thực hiện công việc giảng dạy, nghiên cứu khoa học.
• Người có từ 05 năm kinh nghiệm làm việc phù hợp với vị trí công việc tại Việt Nam mà không cần bằng đại học.

Đây là một trong những thay đổi đáng chú ý về điều kiện chuyên môn của người lao động nước ngoài.

3. Giảm yêu cầu kinh nghiệm đối với giám đốc điều hành từ 03 năm xuống 02 năm

Theo Nghị định 393, yêu cầu kinh nghiệm đối với trường hợp giám đốc điều hành là người đứng đầu, trực tiếp điều hành một lĩnh vực được giảm từ 03 năm xuống 02 năm.

Điều chỉnh này thuộc nhóm nới lỏng điều kiện chuyên môn đối với người lao động nước ngoài.

4. Gia hạn giấy phép lao động nhanh và đơn giản hơn

Nghị định 393/2026/NĐ-CP đưa ra một số thay đổi quan trọng trong thủ tục gia hạn giấy phép lao động:

• Thời gian giải quyết giảm từ 10 ngày làm việc xuống còn 05 ngày làm việc.
• Thời điểm nộp hồ sơ sớm nhất được mở rộng từ 45 ngày lên 90 ngày trước khi giấy phép hết hạn.
• Hồ sơ gia hạn không yêu cầu giấy khám sức khỏe.
• Thủ tục gia hạn không yêu cầu thông báo tuyển dụng lao động Việt Nam.

Những thay đổi này giúp giảm bớt một số giấy tờ và rút ngắn thời hạn giải quyết hồ sơ gia hạn.

5. Chấp nhận giấy khám sức khỏe do cơ sở nước ngoài cấp

Nghị định 393 chấp nhận giấy khám sức khỏe do cơ sở có thẩm quyền của nước ngoài cấp mà không còn điều kiện về điều ước quốc tế hoặc thỏa thuận thừa nhận lẫn nhau.

Giấy khám sức khỏe phải có thời hạn không quá 12 tháng tính đến ngày nộp hồ sơ.

B. Nhóm quy định được siết chặt

6. Lao động kỹ thuật không còn thuộc diện di chuyển nội bộ doanh nghiệp

Theo Nghị định 393, hình thức di chuyển nội bộ doanh nghiệp chỉ áp dụng đối với ba nhóm vị trí:

• Nhà quản lý.
• Giám đốc điều hành.
• Chuyên gia.

Lao động kỹ thuật không còn thuộc nhóm vị trí được áp dụng hình thức di chuyển nội bộ doanh nghiệp.

Tuy nhiên, thời hạn giấy xác nhận không thuộc diện cấp giấy phép lao động đối với hình thức di chuyển nội bộ doanh nghiệp được kéo dài, tối đa 03 năm.

Nghị định cũng quy định các nội dung chuyển tiếp đối với giấy tờ đã cấp.

7. Siết chặt quy định làm việc ngắn hạn dưới 90 ngày

Nghị định 393 làm rõ cách tính thời gian làm việc ngắn hạn của người lao động nước ngoài tại Việt Nam.

Theo đó, thời gian làm việc được cộng dồn cho một hoặc nhiều người sử dụng lao động, với tổng thời gian không quá 90 ngày trong một năm.

Đáng chú ý, nếu phát sinh quan hệ thuê mướn, sử dụng lao động và trả lương tại Việt Nam thì người sử dụng lao động phải đề nghị cấp giấy phép lao động theo hình thức hợp đồng lao động.

8. Bổ sung yêu cầu lý lịch tư pháp đối với hồ sơ cấp giấy xác nhận miễn giấy phép lao động

Theo Nghị định 393, hồ sơ đề nghị cấp giấy xác nhận người lao động nước ngoài không thuộc diện cấp giấy phép lao động (GXN) theo thủ tục thông thường được bổ sung yêu cầu về phiếu lý lịch tư pháp.

Tuy nhiên, người lao động không phải cung cấp riêng phiếu lý lịch tư pháp nếu cơ quan có thẩm quyền khai thác được thông tin từ cơ sở dữ liệu lý lịch tư pháp theo quy định.

9. Mở rộng nghĩa vụ thông báo địa điểm làm việc

Nghị định 393 mở rộng nghĩa vụ thông báo khi người lao động nước ngoài làm việc tại địa điểm mới hoặc thay đổi địa điểm làm việc có tính chất ổn định, thường xuyên.

Đáng chú ý, nghĩa vụ này áp dụng cả khi thay đổi địa điểm làm việc trong cùng một tỉnh.

Việc thông báo phải được thực hiện với cả cơ quan có thẩm quyền nơi cấp giấy tờ và cơ quan có thẩm quyền tại nơi người lao động làm việc.

10. Quy định trực tiếp trách nhiệm của người sử dụng lao động

Nghị định 393 bổ sung quy định trực tiếp về trách nhiệm của người sử dụng lao động nước ngoài tại Việt Nam.

Hai nội dung đáng chú ý gồm:

Không được cho thuê lại lao động nước ngoài.

Thực hiện chế độ báo cáo định kỳ 06 tháng/lần, với thời điểm báo cáo:

• Trước ngày 05/6 hằng năm.

C. Nhóm quy định về số hóa

11. Khai thác cơ sở dữ liệu thay thế một số giấy tờ trong hồ sơ

Nghị định 393 đẩy mạnh khai thác các cơ sở dữ liệu nhà nước nhằm thay thế một số giấy tờ trong quá trình giải quyết thủ tục.

Các nội dung đáng chú ý gồm:

• Cơ sở dữ liệu lý lịch tư pháp được khai thác để thay thế phiếu lý lịch tư pháp.
• Cơ sở dữ liệu quốc gia về xuất nhập cảnh được khai thác để thay thế thông tin hộ chiếu.

Ngoài ra, hộ chiếu không phải hợp pháp hóa lãnh sự.

D. Nhóm quy định điều chỉnh thời hạn

12. Một số mốc thời gian chuyển sang tính bằng ngày làm việc

Nghị định 393 điều chỉnh cách tính thời hạn đối với một số thủ tục liên quan đến giấy phép lao động và giấy xác nhận không thuộc diện cấp giấy phép lao động.

Cụ thể:

• Nộp hồ sơ cấp, gia hạn: Thời điểm nộp hồ sơ phải đáp ứng yêu cầu tối thiểu 10 ngày làm việc theo thủ tục tương ứng.

Nghị định 393/2026/NĐ-CP có hiệu lực khi nào?

Nghị định số 393/2026/NĐ-CP được Chính phủ ban hành ngày 20/10/2026, quy định về người lao động nước ngoài làm việc tại Việt Nam.

Theo Điều 36, Nghị định chính thức có hiệu lực từ 05/12/2026, thay thế Nghị định số 219/2025/NĐ-CP ngày 07/08/2025.

Nghị định mới điều chỉnh các nội dung liên quan đến điều kiện, hồ sơ, trình tự, thủ tục cấp, cấp lại, gia hạn và thu hồi giấy phép lao động, cũng như giấy xác nhận người lao động nước ngoài không thuộc diện cấp giấy phép lao động.

5 thay đổi quan trọng về giấy phép lao động theo Nghị định 393/2026/NĐ-CP

1. Hồ sơ xin xác nhận miễn giấy phép lao động bổ sung yêu cầu về lý lịch tư pháp

Một trong những thay đổi đáng chú ý nhất tại Nghị định 393/2026/NĐ-CP là yêu cầu bổ sung giấy tờ về lý lịch tư pháp đối với hồ sơ đề nghị cấp giấy xác nhận không thuộc diện cấp giấy phép lao động (GXN) theo thủ tục thông thường.

Theo quy định trước đây

Nghị định 219/2025/NĐ-CP không yêu cầu phiếu lý lịch tư pháp trong thành phần hồ sơ cấp GXN thông thường.

Theo quy định mới từ 05/12/2026

Khoản 6 Điều 9 Nghị định 393 bổ sung yêu cầu về phiếu lý lịch tư pháp hoặc văn bản xác nhận tình trạng tư pháp theo quy định.

Giấy tờ phải được cấp không quá 06 tháng tính đến ngày nộp hồ sơ.

Tuy nhiên, doanh nghiệp cần lưu ý các ngoại lệ:

• Trường hợp nộp hồ sơ trực tuyến và cơ quan có thẩm quyền khai thác được thông tin từ cơ sở dữ liệu lý lịch tư pháp thì không phải cung cấp riêng phiếu lý lịch tư pháp theo Điều 7.
• Một số thủ tục cấp GXN theo hồ sơ rút gọn tại khoản 7 và khoản 8 Điều 9 không yêu cầu thành phần lý lịch tư pháp theo khoản 6.
• Một số trường hợp không thuộc diện cấp giấy phép lao động chỉ phải thông báo với cơ quan có thẩm quyền theo khoản 4 Điều 10, thay vì thực hiện thủ tục xin GXN.

Đối với lý lịch tư pháp hoặc giấy tờ tương đương được cấp ở nước ngoài, hồ sơ phải đáp ứng yêu cầu về hợp pháp hóa lãnh sự, dịch sang tiếng Việt và chứng thực bản dịch theo Điều 6, trừ trường hợp được miễn hợp pháp hóa lãnh sự.

Doanh nghiệp có thể gặp rủi ro gì?

Việc bổ sung yêu cầu về lý lịch tư pháp có thể làm tăng thời gian chuẩn bị hồ sơ, đặc biệt đối với người lao động đang ở nước ngoài hoặc cần xin giấy tờ tại quốc gia đã từng cư trú.

Nếu không kiểm tra trước thành phần hồ sơ hoặc thời hạn của giấy tờ, doanh nghiệp có thể phải bổ sung tài liệu và điều chỉnh kế hoạch tiếp nhận nhân sự.

2. Lao động kỹ thuật không còn thuộc diện di chuyển nội bộ doanh nghiệp

Thay đổi này có tác động đáng kể đến doanh nghiệp FDI, tập đoàn đa quốc gia và các công ty thường xuyên điều chuyển nhân sự từ nước ngoài sang Việt Nam.

Theo khoản 1 Điều 3 Nghị định 393/2026/NĐ-CP, hình thức di chuyển trong nội bộ doanh nghiệp chỉ áp dụng đối với ba nhóm vị trí:

• Nhà quản lý.
• Giám đốc điều hành.
• Chuyên gia.

Người lao động còn phải đáp ứng điều kiện đã được doanh nghiệp ở nước ngoài tuyển dụng ít nhất 12 tháng liên tục và các điều kiện khác theo quy định.

Như vậy, vị trí lao động kỹ thuật không còn thuộc nhóm đối tượng được áp dụng hình thức di chuyển trong nội bộ doanh nghiệp.

Điều này không đồng nghĩa với việc tất cả kỹ sư nước ngoài đều bị loại khỏi hình thức di chuyển nội bộ. Người làm công việc kỹ thuật vẫn có thể được xem xét theo vị trí chuyên gia nếu đáp ứng các điều kiện tương ứng.

Giấy phép lao động đã được cấp có còn hiệu lực không?

Theo khoản 3 Điều 35 Nghị định 393, giấy phép lao động và GXN đã cấp, cấp lại hoặc gia hạn cho vị trí lao động kỹ thuật theo hình thức di chuyển nội bộ doanh nghiệp theo Nghị định 219 vẫn tiếp tục được sử dụng đến hết thời hạn.

Đối với việc cấp lại hoặc gia hạn theo quy định chuyển tiếp này, người lao động phải đáp ứng điều kiện của vị trí chuyên gia theo điểm e khoản 3 Điều 4, bao gồm ít nhất 05 năm kinh nghiệm làm việc phù hợp với vị trí dự kiến tại Việt Nam.

Khuyến nghị từ 68 SOLUTIONS: Rà soát danh sách nhân sự nước ngoài đang làm việc theo hình thức di chuyển nội bộ, phân loại vị trí công việc và kiểm tra hồ sơ chứng minh kinh nghiệm trước khi giấy phép hết hạn.

3. Thời hạn nộp hồ sơ giấy phép lao động chuyển sang tính bằng ngày làm việc

Một thay đổi quan trọng khác trong Nghị định 393/2026/NĐ-CP liên quan đến cách tính thời điểm nộp hồ sơ.

Theo khoản 1 Điều 10 và khoản 1 Điều 23, hồ sơ đề nghị cấp giấy phép lao động hoặc GXN phải được nộp:

• Trước ít nhất 10 ngày làm việc so với ngày người lao động dự kiến bắt đầu làm việc.
• Không quá 60 ngày trước ngày dự kiến bắt đầu làm việc.

Trước đây, Nghị định 219 quy định thời hạn tối thiểu 10 ngày theo lịch.

Sự khác biệt giữa ngày làm việc và ngày theo lịch có thể ảnh hưởng đáng kể đến lịch trình chuẩn bị hồ sơ, nhất là khi thời gian nộp rơi vào dịp nghỉ lễ hoặc Tết.

Đối với thủ tục gia hạn

Theo khoản 1 Điều 17 và khoản 1 Điều 29 Nghị định 393, hồ sơ gia hạn giấy phép lao động hoặc GXN phải được nộp:

• Trước ít nhất 10 ngày làm việc so với ngày hết hạn.
• Không quá 90 ngày trước ngày hết hạn.

Doanh nghiệp cần phân biệt rõ mốc tối thiểu 10 ngày làm việc với các mốc 60 ngày và 90 ngày được tính theo ngày lịch.

Khuyến nghị từ 68 SOLUTIONS: Cập nhật lại hệ thống quản lý thời hạn giấy phép lao động, chuyển lịch nhắc nộp hồ sơ sang ngày làm việc và tính toán cả các kỳ nghỉ lễ để tránh nộp hồ sơ ngoài khoảng thời gian quy định.

4. Thông báo tuyển dụng người Việt Nam phải thực hiện trước ít nhất 05 ngày làm việc

Theo Mẫu số 03, Mục II, Phụ lục I của Nghị định 393/2026/NĐ-CP, đối với các trường hợp tuyển dụng lao động nước ngoài thuộc điểm a, i và m khoản 1 Điều 2, người sử dụng lao động phải thực hiện thông báo tuyển dụng lao động Việt Nam vào vị trí dự kiến sử dụng người lao động nước ngoài.

Thông báo phải được thực hiện trước ít nhất 05 ngày làm việc tính đến ngày nộp hồ sơ đề nghị cấp giấy phép lao động.

Các trường hợp áp dụng bao gồm:

• Người lao động nước ngoài làm việc theo hợp đồng lao động.
• Người lao động nước ngoài thực hiện gói thầu, dự án tại Việt Nam.
• Người lao động nước ngoài làm việc cho cơ quan đại diện ngoại giao nước ngoài hoặc tổ chức nước ngoài tại Việt Nam thuộc trường hợp được quy định.

Thông báo có thể được đăng trên sàn giao dịch việc làm quốc gia, thông qua tổ chức dịch vụ việc làm, trên phương tiện thông tin đại chúng hoặc trang thông tin điện tử của người sử dụng lao động.

Điểm mới doanh nghiệp cần lưu ý

Nội dung thông báo phải thể hiện các thông tin cơ bản về vị trí công việc, lĩnh vực làm việc, hình thức làm việc, địa điểm, thời hạn, trình độ chuyên môn kỹ thuật và kinh nghiệm làm việc (nếu có).

Theo điểm c, d khoản 6 Điều 37, việc tuyển dụng người lao động nước ngoài phải bảo đảm yêu cầu về trình độ và kinh nghiệm, phù hợp với nội dung tuyển dụng đã thông báo.

Một ngoại lệ quan trọng là người lao động nước ngoài giữ chức danh tổng giám đốc hoặc giám đốc đã có tên trên giấy đăng ký kinh doanh được miễn yêu cầu thông báo tuyển dụng này theo hướng dẫn tại Mẫu số 03.

Ngoài ra, yêu cầu thông báo tuyển dụng theo Mẫu số 03 áp dụng đối với thủ tục cấp giấy phép lao động trong các trường hợp quy định, không áp dụng đối với thủ tục gia hạn.

Khuyến nghị từ 68 SOLUTIONS: Chuẩn hóa nội dung thông báo tuyển dụng, kiểm tra sự phù hợp giữa yêu cầu công việc với hồ sơ của người lao động nước ngoài và lưu giữ bằng chứng về ngày đăng thông báo.

5. Mẫu hồ sơ mới yêu cầu mã ngành kinh tế cấp 4 và mã nghề cấp 5

Nghị định 393/2026/NĐ-CP ban hành hệ thống biểu mẫu mới tại Phụ lục I, trong đó có Mẫu số 01 và Mẫu số 03.

Theo hướng dẫn tại các mẫu này, doanh nghiệp cần chú ý đến cách kê khai thông tin về lĩnh vực kinh doanh và công việc dự kiến của người lao động nước ngoài.

Cụ thể:

• Mã ngành kinh tế cấp 4: Sử dụng theo Quyết định số 36/2025/QĐ-TTg đối với thông tin lĩnh vực kinh doanh chính.
• Mã nghề cấp 5: Sử dụng theo Quyết định số 34/2020/QĐ-TTg để xác định công việc, nghề nghiệp dự kiến.
• Trường hợp chưa có mã phù hợp: Ghi rõ tên công việc hoặc nghề nghiệp cụ thể theo hướng dẫn biểu mẫu.

Việc tiếp tục kê khai theo mã cũ hoặc mô tả công việc quá chung chung có thể khiến hồ sơ cần được sửa đổi, bổ sung để phù hợp với biểu mẫu mới.

Đặc biệt, thông tin về chức danh, lĩnh vực làm việc, mã nghề và giấy tờ chứng minh trình độ, kinh nghiệm cần có sự thống nhất.

Khuyến nghị từ 68 SOLUTIONS: Cập nhật các biểu mẫu mới, đối chiếu mã ngành và mã nghề trước khi nộp hồ sơ, đồng thời kiểm tra sự thống nhất giữa thông tin kê khai và giấy tờ chứng minh.

Không chỉ điều chỉnh một số yêu cầu hồ sơ, Nghị định 393/2026/NĐ-CP còn mang đến các thay đổi thuận lợi cho doanh nghiệp trong thủ tục gia hạn giấy phép lao động.

Thời gian xử lý gia hạn giảm còn 05 ngày làm việc

Theo khoản 3 Điều 29, thời hạn giải quyết hồ sơ gia hạn giấy phép lao động giảm từ 10 ngày làm việc xuống còn 05 ngày làm việc, kể từ ngày cơ quan có thẩm quyền nhận đủ hồ sơ theo quy định.

Đây là thay đổi đáng chú ý giúp doanh nghiệp có thể chủ động hơn trong kế hoạch quản lý nhân sự nước ngoài.

Được nộp hồ sơ gia hạn sớm đến 90 ngày

Theo khoản 1 Điều 29, doanh nghiệp có thể nộp hồ sơ gia hạn trong khoảng thời gian từ 90 ngày đến trước ít nhất 10 ngày làm việc so với ngày giấy phép hết hiệu lực.

So với mốc tối đa 45 ngày trước đây, quy định mới mở rộng khoảng thời gian để doanh nghiệp chuẩn bị và nộp hồ sơ.

Hồ sơ gia hạn không còn yêu cầu giấy khám sức khỏe

Theo Điều 28, hồ sơ gia hạn giấy phép lao động không còn yêu cầu giấy khám sức khỏe.

Đồng thời, quy trình gia hạn không áp dụng yêu cầu thông báo tuyển dụng người lao động Việt Nam tại Mẫu số 03, Mục II.

Điều này giúp giảm một số công việc hành chính khi doanh nghiệp tiếp tục sử dụng người lao động nước ngoài đáp ứng điều kiện gia hạn.

Chấp nhận giấy khám sức khỏe do nước ngoài cấp

Theo khoản 2 Điều 19, hồ sơ cấp giấy phép lao động có thể sử dụng giấy khám sức khỏe do cơ sở khám bệnh, chữa bệnh có thẩm quyền của nước ngoài cấp.

Giấy khám sức khỏe phải được cấp không quá 12 tháng tính đến ngày nộp hồ sơ.

Đối với giấy tờ được cấp ở nước ngoài, doanh nghiệp vẫn cần đáp ứng các yêu cầu về hợp pháp hóa lãnh sự, dịch sang tiếng Việt và chứng thực theo Điều 6, trừ trường hợp được miễn hợp pháp hóa lãnh sự.

Như vậy, dù một số quy định mới đòi hỏi doanh nghiệp chuẩn bị kỹ hơn, Nghị định 393 vẫn có những điều chỉnh giúp việc gia hạn giấy phép lao động thuận lợi hơn.

Câu hỏi thường gặp về Nghị định 393/2026/NĐ-CP

1. Nghị định 393/2026/NĐ-CP có hiệu lực từ ngày nào?

Theo Điều 36, Nghị định 393/2026/NĐ-CP có hiệu lực từ ngày 05/12/2026 và thay thế Nghị định 219/2025/NĐ-CP về người lao động nước ngoài làm việc tại Việt Nam.

2. Hồ sơ giấy phép lao động nộp trước ngày 05/12/2026 có phải làm lại không?

Theo khoản 2 Điều 35, hồ sơ đề nghị cấp, cấp lại, gia hạn hoặc thu hồi giấy phép lao động, GXN đã được nộp trước ngày Nghị định 393 có hiệu lực tiếp tục được giải quyết theo Nghị định 219.

Riêng hồ sơ gia hạn thuộc quy định chuyển tiếp tại khoản 5 Điều 35 được tiếp tục xem xét theo Nghị quyết số 24/2026/NQ-CP trong phạm vi được quy định.

3. Giấy phép lao động đã cấp trước ngày 05/12/2026 có còn hiệu lực không?

Có.

Theo khoản 1 Điều 35, giấy phép lao động và GXN đã được cấp, cấp lại hoặc gia hạn theo Nghị định 219/2025/NĐ-CP và Nghị định 70/2023/NĐ-CP tiếp tục có giá trị đến hết thời hạn.

Doanh nghiệp không phải thực hiện lại thủ tục chỉ vì Nghị định 393 bắt đầu có hiệu lực.

Các thủ tục phát sinh sau đó được thực hiện theo quy định mới và các điều khoản chuyển tiếp tương ứng.

4. Giấy phép lao động được gia hạn tối đa bao nhiêu lần?

Theo Điều 30 Nghị định 393, giấy phép lao động chỉ được gia hạn 01 lần, với thời hạn gia hạn tối đa 02 năm.

Trường hợp người lao động đã gia hạn nhưng có nhu cầu tiếp tục làm việc tại cùng vị trí và lĩnh vực, doanh nghiệp thực hiện thủ tục đề nghị cấp giấy phép lao động theo khoản 3 Điều 21.

Hồ sơ phải được nộp trước ít nhất 10 ngày làm việc và không quá 60 ngày trước khi giấy phép hiện tại hết hiệu lực.

5. Nghị định 393 có áp dụng đối với giáo viên nước ngoài không?

Có. Nghị định 393 điều chỉnh người lao động nước ngoài làm việc tại Việt Nam, bao gồm người lao động trong lĩnh vực giáo dục.

Tùy trường hợp cụ thể, giáo viên nước ngoài phải có giấy phép lao động hoặc đáp ứng điều kiện không thuộc diện cấp giấy phép lao động.

Khoản 14 Điều 8 Nghị định 393 cũng quy định một số trường hợp không thuộc diện cấp giấy phép lao động dành cho người nước ngoài làm việc tại các cơ sở giáo dục.

Tuy nhiên, không phải mọi giáo viên nước ngoài đều tự động được miễn giấy phép lao động. Việc áp dụng phụ thuộc vào vị trí, trình độ, chương trình giảng dạy và các điều kiện liên quan.

Doanh nghiệp cần chuẩn bị gì trước ngày 05/12/2026?

Để hạn chế những sai sót khi áp dụng Nghị định 393/2026/NĐ-CP, doanh nghiệp nên chủ động rà soát tình trạng hồ sơ của người lao động nước ngoài trước thời điểm có hiệu lực.

Các công việc cần ưu tiên gồm:

1. Kiểm tra giấy phép lao động và GXN hiện tại: Xác định loại giấy tờ, vị trí công việc, hình thức làm việc và ngày hết hạn của từng nhân sự.
2. Rà soát hồ sơ miễn giấy phép lao động: Xác định các trường hợp cần bổ sung giấy tờ về lý lịch tư pháp hoặc được áp dụng thủ tục rút gọn.
3. Đánh giá nhân sự di chuyển nội bộ: Đặc biệt lưu ý các trường hợp lao động kỹ thuật và điều kiện chứng minh kinh nghiệm làm việc.
4. Cập nhật lịch nộp hồ sơ: Phân biệt ngày làm việc và ngày lịch, nhất là đối với hồ sơ sắp hết hạn.

Work Permit Exemption Certificate Applications Will Require Criminal Record Documentation

Under Decree 219, applications for a Certificate of Work Permit Exemption (hereinafter referred to as an “Exemption Certificate”) generally did not require a criminal record certificate.

However, effective December 5, 2026, Clause 6, Article 9 of Decree 393 introduces a requirement for a criminal record certificate or equivalent document confirming the applicant’s criminal record status for applications submitted under the standard Exemption Certificate procedure.

The document must have been issued within six months before the application submission date.

Employers should pay particular attention to the following exceptions:

• Where an application is submitted online and the competent authority can retrieve the required information from the criminal record database, the applicant is not required to provide a separate criminal record certificate under Article 7.
• Certain simplified Exemption Certificate procedures under Clauses 7 and 8, Article 9 do not require the criminal record documentation specified in Clause 6.
• Certain categories of foreign workers exempt from work permit requirements are only subject to notification procedures under Clause 4, Article 10, rather than an application for an Exemption Certificate.

For criminal record certificates or equivalent documents issued overseas, consular legalization, Vietnamese translation, and certification of the translation are required under Article 6, unless an exemption from consular legalization applies.

Obtaining these documents may take considerable time, particularly when foreign employees are currently overseas or need to obtain criminal record certificates from countries where they previously resided.

What employers should do: Identify the applicable exemption category for each foreign employee, determine the correct documentary requirements, and arrange criminal record documentation sufficiently early to ensure it remains valid at the time of submission.

Technical Workers Will No Longer Qualify for Intra-Company Transfers

This is one of the most significant changes for foreign-invested enterprises and multinational corporations transferring employees from overseas offices to Vietnam.

Under Clause 1, Article 3 of Decree 393, intra-company transfers are limited to foreign employees holding one of the following positions:

• Managers
• Executive Directors
• Experts

The foreign employee must also have been employed continuously by the overseas enterprise for at least 12 months, in addition to meeting the other conditions applicable to intra-company transfers.

As a result, technical workers will no longer qualify as a separate eligible category under the intra-company transfer arrangement.

However, this does not mean that all foreign engineers are prohibited from transferring to Vietnam. An engineer may still qualify for an intra-company transfer if classified as an expert and if all relevant eligibility requirements are satisfied.

Will Previously Issued Work Permits Remain Valid?

Under Clause 3, Article 35 of Decree 393, work permits or Exemption Certificates previously issued, reissued, or extended to technical workers under intra-company transfer arrangements will remain valid until their expiration dates.

For subsequent reissuance or extension, the employee must meet the requirements applicable to experts under Point e, Clause 3, Article 4, including having at least five years of relevant professional experience corresponding to the intended position in Vietnam.

What employers should do: Review all technical workers currently employed under intra-company transfer arrangements, check the expiration dates of their permits or certificates, and evaluate whether they meet the expert classification requirements or whether an alternative employment arrangement is necessary.

Application Deadlines Will Be Calculated in Working Days

A seemingly minor change that could significantly affect recruitment and foreign employee onboarding plans is the calculation of application submission deadlines.

Under Clause 1, Article 10 and Clause 1, Article 23 of Decree 393, applications for an Exemption Certificate or work permit must be submitted:

• At least 10 working days before the intended employment commencement date.
• No more than 60 calendar days before the intended employment commencement date.

By comparison, Decree 219 required submission at least 10 calendar days before the intended start date.

In practice, 10 working days generally represents approximately two calendar weeks, although the actual period may be longer when public holidays are involved.

For work permit or Exemption Certificate extensions, Clause 1, Article 17 and Clause 1, Article 29 of Decree 393 establish the following application window:

• At least 10 working days before the existing document expires.
• No more than 90 calendar days before its expiration date.

Employers must distinguish between these deadlines: the minimum 10-day requirement is calculated in working days, while the 60-day and 90-day limits are calculated in calendar days.

Continuing to use existing deadline-tracking systems without adjustment may result in applications being submitted outside the prescribed period.

What employers should do: Update internal work permit tracking systems, calculate application deadlines using working days, and account for weekends and public holidays when scheduling submissions.

Recruitment Notices for Vietnamese Workers Must Be Published at Least 5 Working Days in Advance

Under Form No. 03, Section II, Appendix I of Decree 393, employers hiring foreign employees under the working arrangements specified in Points a, i, and m, Clause 1, Article 2 must issue a recruitment notice seeking Vietnamese workers for the position intended to be filled by a foreign national.

The recruitment notice must be published at least five working days before the work permit application is submitted.

The relevant working arrangements include:

• Employment under a labor contract.
• Implementation of contracts or projects in Vietnam.
• Employment by foreign diplomatic representative offices or foreign organizations in Vietnam, where applicable under the specified provisions.

Employers may publish recruitment notices through the national employment exchange platform, employment service organizations, mass media, or their own official websites, in accordance with the regulations.

The recruitment notice must contain sufficient information regarding the job position, field of work, working arrangement, workplace, employment duration, required qualifications, and work experience, where applicable.

Notably, the new application form expressly includes work experience among the recruitment notice requirements.

Under Points c and d, Clause 6, Article 37, the qualifications and experience of the foreign employee proposed for recruitment must be consistent with the published recruitment requirements and must not fall below the stated standards.

Exception: Foreign employees holding the position of General Director or Director whose names are already recorded on the enterprise’s business registration certificate are exempt from this recruitment notification requirement, as specified in the instructions to Form No. 03.

Additionally, the recruitment notification requirement under Form No. 03 applies to relevant initial work permit applications and does not apply to work permit extensions.

What employers should do: Standardize recruitment notices under the new regulations, ensure consistency between the published requirements and the foreign employee’s qualifications, and retain evidence of the publication date.

New Application Forms Require Level-4 Economic Sector Codes and Level-5 Occupation Codes

Decree 393 introduces updated application forms under Appendix I, including Form No. 01 and Form No. 03, which are used in procedures relating to work permit exemptions and the issuance, reissuance, or extension of work permits.

According to the instructions accompanying these forms, employers must provide more detailed information regarding their business activities and the foreign employee’s occupation:

• Principal business activity: Use the Level-4 economic sector code under Decision No. 36/2025/QD-TTg.
• Intended occupation or job: Use the Level-5 occupation code under Decision No. 34/2020/QD-TTg.
• Where no corresponding occupation code exists, clearly specify the relevant job or occupation.

Continuing to use outdated codes or overly general job descriptions may result in requests to amend or supplement the application to comply with the updated forms.

Employers should ensure that the occupation code, job title, field of work, and supporting documents demonstrating the employee’s qualifications and professional experience are consistent.

What employers should do: Update internal application templates, review the applicable economic sector and occupation codes, and verify consistency across all supporting documents before submission.

Good News: Work Permit Extension Procedures Will Become Faster and Simpler

Alongside these new requirements, Decree 393 introduces several favorable changes for employers and foreign employees.

The most notable improvements concern work permit extension procedures.

Faster Processing Time

Under Clause 3, Article 29, the statutory processing time for work permit extension applications will be reduced from 10 working days to five working days, calculated from the date the competent authority receives a complete and valid application.

Extended Application Window

Employers will be permitted to submit extension applications up to 90 calendar days before the work permit expires, compared with the previous 45-day limit.

However, applications must still be submitted at least 10 working days before the expiration date.

Reduced Documentation Requirements

Under Article 28, work permit extension applications will no longer require a medical examination certificate.

Additionally, the Vietnamese worker recruitment notification requirement under Form No. 03, Section II applies to initial work permit applications in the prescribed cases, rather than extension applications.

Greater Flexibility for Medical Certificates Issued Overseas

Under Clause 2, Article 19, medical examination certificates issued by authorized foreign healthcare facilities will be accepted if issued within 12 months before the application submission date.

Medical certificates issued overseas must still undergo consular legalization, translation into Vietnamese, and certification of the translation under Article 6, unless an exemption from consular legalization applies.

These changes are expected to give employers more time to prepare applications, reduce administrative paperwork, and improve their ability to maintain foreign employees’ lawful working status in Vietnam.

Frequently Asked Questions About Decree 393/2026/ND-CP

Which Regulations Apply to Work Permit Applications Submitted Before December 5, 2026?

Under Clause 2, Article 35 of Decree 393, applications for the issuance, reissuance, extension, or revocation of work permits or Exemption Certificates submitted before December 5, 2026, will continue to be processed under Decree 219.

Certain extension applications covered by the separate transitional provisions under Clause 5, Article 35 will be processed according to the applicable provisions.

Must Previously Issued Work Permits and Exemption Certificates Be Replaced?

No.

Under Clause 1, Article 35 of Decree 393, work permits and Exemption Certificates issued, reissued, or extended under Decree 219 and Decree No. 70/2023/ND-CP will remain valid until their respective expiration dates.

Subsequent issuance, reissuance, or extension procedures must comply with Decree 393 and its applicable transitional provisions.

How Many Times Can a Work Permit Be Extended?

Under Article 30 of Decree 393, a work permit may be extended only once, for a maximum extension period of two years.

If a foreign employee has already received a work permit extension and intends to continue working in the same position and field, the employer must apply for a work permit under Clause 3, Article 21.

The application must be submitted at least 10 working days and no more than 60 calendar days before the existing work permit expires.

What Should Employers Prepare Before December 5, 2026?

The changes introduced by Decree 393 will affect not only application documentation but also recruitment planning, work permit expiration management, and foreign workforce arrangements.

Employers should proactively review pending applications, work permits approaching expiration, and foreign recruitment plans scheduled for implementation after December 5, 2026.

Particular attention should be given to Exemption Certificate applications, employees working under intra-company transfer arrangements, and positions requiring Vietnamese worker recruitment notices.

Early preparation can help minimize requests for additional documentation and reduce the risk of disruptions to foreign employee onboarding and workforce management.
